- Abstract
- The Platts Electric Market Areas geospatial data layer contains regions representing the geographic extent of electric price clearing markets. If a planning area is not affected by transmission constraints, then the market area will have one-to-one relationship with its associated planning area. If there are known transmission constraints dividing a planning area, two or more market areas will be created within a planning area to display the market extents.

- DATA AND/OR SPATIAL LAYER CONTENT AGREEMENT1. Platts, a division of The McGraw-Hill Companies, Inc. ("McGraw-Hill") hereby grants to the Subscriber designated below, a nonexclusive, limited right and license to receive, store and internally distribute the data and/or spatial layer(s) (hereafter referred to as "Content") listed below solely for internal and educational use in connection with Subscriber's internal business operations, studies, and dissertations, research, and educational use subject to the terms and conditions set forth herein. Subscriber may use data output in scholarly and educational activities, and may modify data by combining it with other compatible software products and data, as long as appropriate attribution notices are included.Nothing in this section or elsewhere in the agreement shall be interpreted to limit Fair Use, section 107 of US copyright law.2. As used herein, "Subscriber" shall mean the entity designated below and any direct wholly-owned subsidiaries of that entity, but no other entity, whether or not affiliated with Subscriber. As used herein, "Authorized User" shall mean an employee of Subscriber entitled to access the Content to be delivered by the methods specified page 1 hereto. "Authorized Addresses" shall mean the Subscriber site or sites specifically identified on page 1.3. Subscriber agrees that it shall not permit any individual not employed by or a student, faculty, or staff member of Authorized Company specified on Page1 for each Publication to access such Content and Subscriber shall implement sufficient security measures (such as the issuance of passwords and user id's) to assure compliance with this restriction. Subscriber and its Authorized Users shall not knowingly, except as expressly permitted herein, sell, transfer, redistribute, reproduce, forward, republish or otherwise provide in any medium, print or electronic, the Content or any portion, component, derivation, revision or combination thereof, to any other person or entity, whether inside or outside the Subscriber organization, or use the Content for any purpose except as expressly authorized in Section 1 above. Copying or printing is not permitted without the express prior permission of McGraw-Hill, except as allowed under US copyright law section 107, Fair Use .4. Subscriber agrees and acknowledges that all proprietary rights in the Content, including but not limited to copyrights and trademarks, are the sole and exclusive property of McGraw-Hill and Subscriber agrees to cooperate fully with any reasonable requests by McGraw-Hill to protect such rights. Subscriber shall not permit the deletion or obscuration of any copyright, trademark or other notices provided by McGraw-Hill as part of or in connection with the Content. 5. MCGRAW-HILL MAKES NO WARRANTIES AS TO THE ACCURACY, ADEQUACY OR COMPLETENESS OF THE CONTENT OF ANY OF THE CONTENT OR OTHERWISE AND ANY WARRANTIES IN CONNECTION WITH THE CONTENT, WHETHER EXPRESS OR IMPLIED, ARE EXPRESSLY DISCLAIMED. MCGRAW-HILL SHALL HAVE NO LIABILITY FOR ANY DAMAGES, WHETHER DIRECT OR INDIRECT, SPECIAL, OR CONSEQUENTIAL IN CONNECTION WITH THE CONTENT OR ANY USE THEREOF. IN THE EVENT THAT LIABILITY IS NEVERTHELESS IMPOSED ON MCGRAW-HILL, MCGRAW-HILL'S CUMULATIVE LIABILITY SHALL NOT EXCEED THE AMOUNT OF THE FEE PAID. No action, regardless of form, may be brought by Subscriber against McGraw-Hill arising out of the Agreement more than one (1) year after such action has occurred. 6. McGraw-Hill may terminate this Agreement at any time in the event of any breach of any provision by Subscriber. The provisions of paragraphs 3, 4 and 5, above, shall survive any termination. Upon termination of this Agreement for any reason, Subscriber shall make reasonable edits to promptly delete all copies of the Content in its possession, including from its storage facilities and computer systems, and upon McGraw-Hill's request certify to McGraw-Hill in writing that it has done so.8. Subscriber shall pay the Fee(s) for Content listed on Schedule 1 as set forth below within (30) days of receipt of invoice. 9. This Agreement: (i) represents the complete agreement between the parties regarding the subject matter hereof, and supersedes any prior understanding or agreements regarding this subject matter, (ii) may only be modified in a writing signed by both parties; (iii) is not assignable or transferable by Subscriber without the approval of McGraw-Hill; and (iv) is governed by the laws of the State of New York, without regard to its choice of law provisions.
